Terms of Service
Effective date: July 14, 2026
These Terms of Service (“Terms”) govern your access to and use of the Impuls Deutsch Vocabulary Trainer (the “Service”), operated by Niko Tracksdorf (“we,” “us”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
The Service is an online vocabulary-study tool aligned to the Impuls Deutsch textbook series. Teachers create classes and assign units; students study through spaced-repetition sessions and can view their progress. Features may change over time.
2. Eligibility
The Service is intended for users age 13 and older. Users under 13 may use the Service only where a school or institution authorizes and consents to that use on parents’ behalf for a school-directed educational purpose (see Section 6 and the Data Processing Agreement).
3. Accounts
- You must provide accurate information and keep your credentials confidential.
- You are responsible for activity under your account. Do not share your login.
- Notify us promptly of any unauthorized use at support@impulsdeutsch.com.
4. Acceptable use
You agree not to:
- access accounts or data that are not yours, or circumvent access controls;
- disrupt, overload, probe, or attempt to breach the Service or its infrastructure;
- scrape, copy, or redistribute Service content except as intended for personal study;
- upload unlawful, infringing, or malicious content; or
- use the Service to violate any applicable law or institutional policy.
5. Institutional and instructor use
Where an instructor or institution uses the Service with students, the institution is responsible for its use of student data consistent with applicable law and its own policies. We act as a school official and service provider processing student data on the institution’s behalf as described in our Privacy Policy, FERPA statement, and Data Processing Agreement.
6. Authority for younger students
An instructor or institution that enrolls or invites students who are under 13 (for example, dual- or concurrent-enrollment high-school students) represents and warrants that it is authorized to do so and to provide any parental consent required under COPPA and applicable law for a school-directed educational purpose, and it agrees that we will use such students’ information only to provide the Service and for no commercial purpose.
7. Intellectual property
The Service, its software, and its instructional content are owned by us and/or our licensors and are protected by intellectual-property laws. Impuls Deutsch and related textbook materials are the property of their respective rights holders. We grant you a limited, non-exclusive, non-transferable license to use the Service for your own educational use. You retain any rights in content you submit.
8. Fees
The Service is currently provided free of charge to institutions approved by us for pilot or prototype use. We may introduce fees for some or all use in the future; if we do, we will provide notice and applicable terms before charging.
9. Privacy
Our collection and use of personal information is described in the Privacy Policy, which is incorporated into these Terms.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that grades or scores are suitable for any particular official use.
11. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data or profits, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim or US$100.
12. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your misuse of the Service or your violation of these Terms or applicable law, to the extent permitted by law (and, for public institutions, subject to applicable law governing such obligations).
13. Termination
You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms or to protect the Service. On termination, the data-return and deletion provisions of the Privacy Policy and DPA apply.
14. Governing law
These Terms are governed by the laws of the State of Rhode Island, USA, without regard to its conflict-of-laws rules, and you consent to the jurisdiction of the state and federal courts located in Rhode Island.
15. Changes to these Terms
We may update these Terms; the updated version will be posted here with a new effective date. Material changes affecting institutions will be communicated with reasonable notice. Continued use after changes take effect constitutes acceptance.
